Lesson Terms and Conditions

Introduction
The following terms and conditions sets out the areas and requirements which a pupil must agree to for the provision of services in relation to the driving lessons which is provided.

1. General Conduct
As a professional driving instructor we operate with professionalism and maintain ethical statics at all times. We are courteous, polite, tidy and punctual. The car use in training will be well maintained, clean and tidy. The car used is fitted with dual-controls as part of standard equipment. The car is of course fully insured for driving tuition. There is a no smoke policy during tuition, neither is there any use of your lesson time to conduct other form of business, personal or otherwise.

2. Qualifications
As a qualified driving instructor we are expected be licensed by the Driving Standards Agency (DVSA) to give driving tuition. This involves passing certain tests and a Criminal Record Bureau check.

3. Course Materials
 

4. Driving License and Eyesight
The learner must hold a current, valid driving license (provisional or full), which must be produced on or in advance of their first lesson. The learner must also check that they can read a number plate at a distance of 20.5 meters (i.e. 67 feet - about 5 car lengths) with glasses if normally worn.

5. Payments
Payments must be made in advance of the training by any of the below method.

a) Pay As You Go - Cash or Bank Transfer

If not already paid. On the 1st lesson two payments are required to cover the 1st lesson and the 2nd lesson. When booking the next lesson the payment will be required. If no payment is recieved then the booking cannot be made.

b) Block Booking - Cash or BT

Payment must be received if using BT 1 week in advance of the 1st lesson date. When the block is used up the following block needs to be paid 1 week prior.

c) Intensive 1 Week - Cash or BT

To book a course, a 50% deposit is reqquired to provionally book with the remaining 50% paid 2 weeks before the course is due to begin. If the course starts within 4 weeks of the 1st lesson date then the full cost is required.

d) The deposit or any subsequent training fees paid are non- refundable in the event you decide to cancel the training once the booking has been accepted by the instructor and the start date agreed. Where block bookings or courses are paid for in advance and the customer fails to turn up or decides to cancel before or during, no refunds will be made. At this point a binding agreement is made between yourself and the instructor. This does not in any way affect your statutory rights to be provided with the services you have bought.

e) We reserve the right to charge a late payment fee of £5 per day for every day an outstanding fee balance remains unpaid from a set date specified by PDS.

6. Customer Care

Deposits will be refunded based on the discretion of the instructor where cancellation falls outside of the specified period based on lessons agreed upon.

7. Lesson Postponement
a) Provided the instructor can easily obtain additional work for any individual lessons postponed, no penalty will be incurred. If this is not possible the full training fee for the period in question may, at the total discretion of the instructor, be lost or charged. The instructor reserves the right to postpone lessons if he or she feels the weather or road conditions are unsuitable or dangerous. The instructor cannot be held responsible for any costs incurred as a result of him or her having to postpone any lessons, for whatever reason.

b) Any lesson duration agreed upon and then subsequently changed within the 48hr policy is charged for the previously agreed duration in full.

8. The Driving Test

a) Bookings
Driving tests can be booked by you or by the instructor on your behalf. Driving test bookings always take priority over other lessons. Therefore, your lesson may be postponed to allow for someone else's driving test and vice-versa. Changes to lesson bookings as a result of this will be notified immediately. Test appointments must be notified to your instructor at the time of booking during the 15 minutes allowed by the DVSA if booked online. Otherwise, the instructor cannot guarantee to be available for the test. When Tests are booked by the instructor an administration fee of £5.00 is charged.

b) Use of the vehicle
In the interests of customer and public safety the instructor reserves the right to withhold the use of a car for the test if, in their opinion, your driving is actually or potentially dangerous.

c) Test cancellation
The DVSA requires three clear working days notice of cancellation or postponement of your test. Failure to provide the required notice will result in the loss of your test fee. The instructor cannot be held responsible for any postponement or cancellation of tests by you or the DVSA for any reason. However, the instructor will assist you in arranging a new test should this occur. In addition, they will advise you on how to reclaim expenses from the DVSA should they cancel your test without proper notice.

9. Punctuality
In their own interest learners are advised to be punctual for lesson appointments. All appointments will be confirmed the week or the lesson before to ensure that mistakes are avoided. The instructor would normally wait for a maximum of 15 minutes before the full lesson would be abandoned and the lesson fee forfeited or become due for payment. A reciprocal waiting time may become necessary if the instructor is delayed due to unforeseen circumstances. Any lesson time lost as a result of this would be made up by the instructor either at the end of the normal lesson time if possible or at a later date. Any such shortfall will be noted by the instructor.

If any party is late for any reason, the person should make contact via telephone or text immediately or within the 15 minute period.

10. Learner Comfort and Safety
In the interests of comfort and safety, learners are advised to wear suitable footwear and clothing which does not restrict movement. Learners must also take note of any medication they are taking that may affect their ability to drive safely and inform their instructor accordingly before taking any lesson booked.

11. Complaints
In the event of a complaint all efforts must be made to resolve the problem directly with the instructor. However, please do not let a problem linger.

12. Your statutory rights
These terms and conditions will not reduce your statutory rights relating to faulty or incorrectly described goods or services provided. The instructor has a statutory obligation to provide you with goods and services fit for the purpose for which they were bought and as described. Similarly, any goods supplied must also be fit for the purpose for which they were bought and as described. If you have any doubts about your statutory rights please contact your local Trading Standards Department or Citizen's Advice Bureau.

13. Photo's and Social Media

From time to time Paul's Driving School will share pupil success photo's on social media. No other personal or sensitive data will be shared.

14. Force Majeure

a) The driving school shall not  be responsible to any other party for any delay in performance or non - performance of duties due to events beyond reasonable control. (such as war, terrorism, fire floor or any other causes beyond our control). 

b) the affected party shall promptly inform the other party in writing stating the cause which has delayed or prevented its performance, thereafter such party shall take all action within its power to comply with the terms of this Agreement as fully and promptly as possible. In events where it is not possible to comply as agreed due to circumstances beyond our control, the driving school will take measures and reserve the right to provide performance in a fair way to ensure that the performance has been provided as agreed.

c) this does not take precedence over any other Claus on this document.

 

15. Industrail Action by others

We reserve the right to make changes to our T&C's from time to time, in such event the on line version at www.pjrdriving.com will be deamed as the original and will superceed any other version.
It is the responsability of the person named below to ensure that they are aware of any amendments.
